Abstract

The technical and legal defects of criminal legislation, imposingliability for environmental crimes, which obstruct its efficient implementation, are grounded. The term “environmental crimes” is considered fictitious. It’s proposed to consider the acts provided by the Chapter 26 of the RF Criminal Code as crimes against environmental components and established rules of their use. These crimes are socially dangerous actsaimed at pollution, destruction, acquisition of environmental components from the natural system, as well as violation of the rules of their use and rules of conducting environmentally hazardous activities entailed environmental deterioration or created the danger of such deterioration. The repugnance between the place of the Chapter 26 in the criminal law structure and goals of criminal law, implying environment preservation along with public safety protection and public order maintenance, is argued. It’s stated that legislators unreasonably narrow the generic and specific objects of environmental crimes through placing the above-mentioned chapter into the part IX. The arguments for placing the crimes against environmental components and established rules of their use into a separate partare given. It’s proposed to divide the specific objects of such crimes into 4 groups (4 chapters of the proposed part). Group 1 includes corpus delictiimposing criminal liability for the acts completely prohibited by the law (pollution, destruction of environmental components). Group 2 includes violations of legislative regulations of theallowed anthropogenic impact on them. Group 3 – acquisition of natural resources, group 4 – violations of the rules of conducting activities having environmentally hazardous potential.
