Abstract

The objective necessity of adjusting the effective legislation in accordance with the established social relations is shown. The law, regulating the legal regime of martial law and the order of its ensuring, establishes the powers of the public authorities of the Russian Federation and its regions. The list of powers is compiled for the regional executive authorities only. However, there is no mention of the regional senior officials in this law. According to the Russian legislation, the regional constitutions (charters) and laws, there are several models of organizing the public authorities in the Russian Federation regions, including those models which do not refer regional senior officials to the system of executive authorities. In such regions senior officials are withdrawn from the sphere of legal regulation in matters of ensuring the regime of martial law. This legal collision contradicts the essence and real role, which the regional senior officials play in the system of public authorities. It is proposed to amend the Federal constitutional law “On martial law” and invest the regional senior officials with the powers in the sphere of ensuring martial law regime, notably with coordinating, securing, administrative and managerial powers. It will allow to eliminate the gap in the legal regulation of this special administrative legal regime and adjust the legislation in accordance with the established organizational legal structure of the regional public authorities.
