Abstract

The urgency of solving the problems of correct defining the objects of relevant criminal trespasses is emphasized, that allows to define the range of protected rights, goods and interests, enables to improve the legislation through correcting its structural content. The specific character of the object of criminal law protection of the Article 169 of the RF Criminal Code is considered. The main object of this group of crimes is public relations related to protection of the entrepreneurial activity principles. But such relations are considered as main object for the above mentioned corpus delicti only in terms of structural position of the norm in the criminal law. The factors allowing to distinguish the object of crimes trespassing on the entrepreneurship sphere and sphere of government and municipal services’ interests are analyzed. They are: 1) any person committing malfeasance simultaneously violates norms and instructions regulating his/her activity; 2) unlawful decisions of state (municipal) agency cause deprivation of its authority and negative attitude of society to public authority; 3) unlawful refusal to register non-profit organization implies that the crime trespasses on the interests of government and municipal services (Article 285 of the RF Criminal Code). The main object of the crime stipulated in the Article 169 is the interests of government and municipal services; but the public relations in the entrepreneurship sphere is additional object (identity papers or warrant, provided in the Article 173.2 of the RF Criminal Code, are the means of committing future crimes being not included into the object structure).
