Abstract |
The current system of penalties provided by Article 44 of the RF Criminal Code is analyzed. It’s argued that changes made to the code during last 5 years led to the fact that the penal system no longer meets certain requirements of the system. The inconsistency of the existing system of punishments with philosophical doctrine of the system and requirements of the system approach, which is a part of jurisprudence methodology, is proved. Amendments to the RF Criminal Code are investigated, features typical for the analyzed system are distinguished. Special attention is paid to the criteria of the system, which the modern penal system doesn’t meet. It’s argued that the main system requirement – the sequence of its structural elements – was violated. It’s proposed to amend the RF Criminal Code to eliminate this drawback. It’s concluded that after increasing fines and changing the essence of a number of penalties they ceased to be consecutive: from less strict to more strict ones. The study of the punitive elements allows to conclude that it’s necessary to exclude the punishment in form of restraint of liberty from Article 44 of the RF Criminal Code and include it in Section VI “Other measures of criminal legal character”, or to expand the number of minor punitive elements of probation by giving this measure additional burdens inherent in the restraint of liberty. It’s proposed to understand the penal system as a comprehensive list of types of punishments arranged hierarchically in a predetermined sequence, according to their functional purpose, nature and comparative severity. |
