Abstract

The constitutional bases of the Ombudsman’s activity in the Russian Federation and foreign countries are analyzed in the article. The author of the article notes that in various states the status of the Ombudsman can be fixed at the level of the constitution, in law, at the level of the
constitution and in the existing legislation. In the Russian Federation the status of the Ombudsman is fixed at the level of the Constitution of the Russian Federation and in the special law. The article
deals with the issues connected with the appointment of Ombudsman in different states. It is noted that in the Russian legislation there is no requirement that the applicant for the position of Ombudsman
should have high moral and ethical qualities. Fixing such requirement in the corresponding law should strengthen the institution of the Ombudsman in the Russian Federation.
