Abstract

According to the author of the article’s opinion, despite the fact that the procedural order of carrying out the investigative actions in the housing is regulated in detail in the legislation, it is far from being perfect. Basing on the analysis of the concept “dwelling”, the most important criteria
that allow to classify a particular object as a residential one, are determined in the article. Certain conditions for carrying out the investigative actions in the home are analyzed, in particular, obtaining
the court decision for carrying out such actions and participation of individuals in them. The author formulates the proposals for improving the legal framework for carrying out the investigative actions
in the housing. They are aimed at increasing the efficiency of crime detection and crime investigation activities, as well as better observance of the rights of participants whose interests are affected in the
course of the investigative actions.
