Abstract

The article deals with the problem of establishing the type of the structure of elements of crimes and the moment of the completion of the incitement actions, the liability for the commission of which is provided by the Special Part of the Criminal Code of the Russian Federation.
Considering the fact that the legislator uses verbal nouns for describing such acts, which can have a dual meaning of the process of committing the act and its result, the author of the article paid special
attention to the etymological meaning of the terms used by the legislator to describe the act. The corresponding decisions of the Plenum of the Supreme Court of the Russian Federation, as well as the
judicial decisions on this category of cases, are analyzed in detail.
