Abstract

The author raises the problem of determining the place and way of the burial of persons whose death occurred as the result of the suppression of the terrorist act committed by them. The questions connected with the possibility of issuing terrorist bodies to the relatives are considered.
The burial order by using the custom is considered. The author pays attention to the fact that, according to the current legislation, the place of burial is determined by the body of preliminary investigation,
and the way of burial is determined by the investigative body or by the specialized funeral service. The preliminary investigation body issues only a notice about which registry office the relatives need to apply
for a death certificate. The legal framework that guides the investigator in choosing the form and place of burial is studied. It is concluded that the solution of the issues raised is connected with the definition
of the legal regime of the human body after his (her) death.
