Abstract

The objective side of the crime, provided by article 171.3 of the Criminal Code of the Russian Federation, is estimated. The author comes to the conclusion that transferring the definition of the concept of turnover of alcoholic beverages from the Federal Law of the Russian Federation of
November 22, 1995 No. 171-FL “On the state regulation of production and trafficking of ethyl alcohol and products containing alcohol and restriction of consumption (drinking) of alcoholic beverages” in the
disposition of the analyzed norm is the wrong decision of the legislator, since the current wording of article 171.3 of the Criminal Code allows the law enforcer to qualify the acts which, within the meaning
of a sectoral legislation, are not subject to compulsory licensing and, therefore, are not criminal, as a crime. The absence of the purpose of sales in the disposition of the analyzed article does not allow to
qualify the facts of purchase of alcoholic beverages, their transportation and storage, committed for subsequent sale as a completed crime. The author of the article has formulated and proposed a new
wording of part 1 of article 171.3 of the Criminal Code of the Russian Federation. In his opinion, it will provide the effective criminal law protection of public relations in the sphere of state regulation of the
turnover of alcoholic beverages.
