Реферат

Незаконная рубка лесных насаждений является актуальной проблемой, требующей изучения криминалистической характеристики данного преступления в целом и способа
его совершения в частности. В статье способы совершения рассматриваемого преступления раскрываются при помощи классификации. Первый критерий предлагаемой классификации основан на характере совершаемых преступных действий. Соответственно, выделяются незаконная рубка,
осуществляемая при помощи бензопил, ручных пил, аккумуляторных пил и иных устройств и
приспособлений, а также повреждения различного характера до степени прекращения роста. Второй критерий классификации – разрешительная документация, имеющаяся у преступника.
В соответствии с ним различаются: рубка, совершаемая при полном или частичном отсутствииразрешительных документов; рубка, совершаемая при наличии поддельных документов; рубка, совершаемая при наличии разрешительных документов, но с нарушениями установленных требований; рубка, совершаемая на основании документов, в которые должностными лицами лесхоза и иных органов умышленно внесены искаженные сведения в интересах лесозаготовителя. По мнению автора статьи, знание отличительных особенностей совершения незаконной рубки лесных насаждений позволит установить следовую картину действий преступников, что положительно отразится на результате всего расследования.

Abstract

Illegal felling of forest plantations is an urgent problem requiring the study of the criminalistic characteristics of the considered crime as a whole and the way of its committing in particular. The ways of committing the analyzed crime are considered by the author of the article by means of classification. The first criterion of the proposed classification is based on the natureof the committed criminal acts. Accordingly, the author of the article distinguishes the illegal felling
carried out by using chainsaws, hand saws, battery saws and other devices, as well as the damage of different types leading to the cessation of tree growth. The second criterion of classification is the
licensing documentation available to the offender. According to this criteria, the following types of illegal felling are distinguished: felling carried out with full or partial lack of permitting documents;
felling carried out with forged documents; felling carried out with permitting documents, but with violations of the established requirements; felling carried out on the basis of documents which contain deliberately distorted information made by officials of forestry and other bodies in the interests of loggers. According to the author’s opinion, the knowledge of distinctive features of the illegal felling of
forest plantations will make it possible to reconstruct the crime scene and to detect the traces of the crime. It will also positively affect the result of the investigation.
