Abstract |
The problem of defining the essence of the concept of forensic ballistic diagnostics is considered. It is stated that scientific conception of forensic ballistic diagnostics is based on the propositions of forensic diagnostics and forensic ballistics theories. Their consolidation establishes the foundation of scientific knowledge of diagnostic forensic ballistic researches. The methodological character and gnoseology of forensic ballistic diagnostics is described and correlation of diagnostics and recognition procedures as well as defining the belonging to a certain group is determined on the basis of the analysis of basic concepts of forensic diagnostics theory. Forensic diagnostics is considered as an activity which is based on cognitive methods of recognition, distinction and defining and aimed both at studying the nature, state, properties and relation of objects connected with an offence, and at formulating significant criminalistical judgments on objects, mechanism and other circumstances of committing a crime, based on obtained data. It is important to define the nature of an object: such information is conditional on defining state, properties and relation of firearms, cartridges and tool marks. The meaning of categories of nature, state, properties and relations is interpreted. The author proposes his own definition of forensic ballistic diagnostics: it is an area of scientific knowledge of forensic ballistics which studies nature, state, properties and relations of firearms, cartridges and tool marks related to an offence, also formulates significant criminalistics judgments on objects, mechanism and other circumstances of committing a crime, based on obtained data. |
