Abstract

The norms of the Federal law “On the narcotic drugs and psychotropic substances” (its regulation subject includes regulative and protective norms) are studied. This law has protective orientation which does not fully satisfy its purpose. Its norms of legal turnover are stated unclearly and unsystematic. But specific character of narcotic drugs and psychotropic substances (NDPS) must be predetermined in the law by their original purpose – medical and scientific and research one. The authors prove the necessity to study the issues of legal turnover of NDPS which provides the accessibility of NDPS for people who need medical treatment. It is proved that special rules stated in the Federal law under consideration should correspond to the general rules stated in the RF Civil Code. The model of legal turnover of NDPS agreed with the norms of the RF Civil Code is proposed. The terminology related to the legal turnover of NDPS, the monopoly of state and other goods owners in these objects, subjects of the turnover whose organizational and legal forms are stated in the RF Civil Code, as well as the features of NDPS as the objects of limited turnover, subjects’ legal rights and duties, required limitations and prohibitions predetermined by the specific character of NDPS are studied. The precise rules of the legal turnover are proved to have not only legal, but also educational and preventive meaning as such turnover is formed by the social norms in the sphere of population health and public morality.
