Abstract

The authors analyze the problems arising while ensuring the RF territorial integrity in light of the events that occurred in recent decades on the territory of CIS and far abroad. Processes caused by the aggressive foreign policy of Western countries led by the USA, from the Soviet Union collapse until recent anti-constitutional coup d’etat in Ukraine, are investigated. The threat to the RF territorial integrity posed by terrorist organization “Islamic State”, which grows in power and influence and threatens to invade the Northern Caucasus, is estimated. The events that happened in Pskov region are estimated, their further development from the perspective of the RF territorial integrity is predicted. The reasons for imposing criminal law ban on public calls for violation of the Russian territorial integrity, including foreign and domestic premises of this act criminalization, are established and analyzed. The key concepts are studied and interpreted: “territory”, “state territory”, “territorial integrity”, “public calls”, “extremist activity”, “non-violent extremist actions”, “non-violent actions aimed at violating the RF territorial integrity”. The interrelationship between public calls for violation of the RF territorial integrity and extremist activity is analyzed. The problems of law enforcement practice from the standpoint of objective element of the crime provided by Article 280.1 of the RF Criminal Code as well as the revealed gaps in legislation are discussed. In this regard the authors raise the question of compliance of the RF Criminal Code Article, providing criminal liability for public calls for violation of the Russian territorial integrity, with the Russian Constitution provisions.
