Abstract |
Some problems of judicial proceedings and judiciary of modern Russia within the framework of ongoing judicial reform are investigated. The necessity of introducing administrative courts and solving the problem of training the judiciary based on historical experience is noted. Uniting the RF Supreme Court and the RF Supreme Arbitration Court is positively estimated as the judicial reform’s beginning. The problem of unreasonably long periods of proceedings is touched upon. The need for the development and adoption of the Concept of the RF judicial policy is proved. It should become a scientific platform for solving the issues of judicial proceedings and judiciary, provide for the development strategy of the Russian judicial system. As the judicial policy is a kind of legal policy, the draft of the Concept of the RF judicial policy should comply with the draft of the Concept of the RF legal policy. Modernization of the judicial system is connected with reorganization of the judiciary, which should meet modern requirements of the Russian society’s development. The general strategic direction of the judicial system’s reform is substantiated – uniting three areas of the judiciary (constitutional, arbitration, general jurisdiction) into one that would be represented by the RF Supreme Court. The expected positive results of such union are called: full unity of judicial practice; concentration of forces and resources, strengthening the judiciary; creating a simple, compact, clear and centralized judicial system; judicial federalism implementation, strengthening legal and judicial resource in the regions; costs savings, replacing judicial system’s external specialization by internal one. |
