Abstract

The authors prove the necessity to reform the stage of criminal case institution related to Soviet inquisitional process, which does not conform to competitive form of criminal procedure. The annual persistent legislative changes of this stage are shown. The analysis of legislative changes over the last years does not allow to reveal the main idea of reforming both initial stage of criminal process and the whole pretrial proceedings (the innovations are contradictory and of obsolete character). There are many departments controlling this stage which establish rules not provided by the RF Criminal Procedure Code. The author proposes to liquidate the stage of criminal case institution, notably: not to process decision on institution of criminal case, to refuse the concept “reason for criminal case institution”, to register crime record in Pretrial proceedings list which automatically indicates the institution of criminal proceedings. Crime record should be implemented in both cases: if there are elements of crime and if there is a necessity to verify the received crime reports. Crime can be unrecorded when the received reports (attached materials) state the absence of crime in act (similarly to grounds for refusal to institute criminal case). The authors consider that amending the RF Criminal Procedure Code will not entail changes in the legal relationship of the first stage of proceedings. It is necessary to refuse the institution of crime detection rate. Bringing indictment to the court and termination of criminal case on rehabilitative grounds should be of equal significance for criminal statistics.
