Abstract

Due to the current reforming, the service in law enforcement agencies is considered as special kind of public service associated with protecting state’s safety, maintaining public order, ensuring legitimacy, rights and liberties of citizens and performed in the interests of public. Performing constitutionally significant functions law enforcement officers must display strict law observance and discipline maintenance. When violating the fixed requirements officers should be brought to disciplinary liability which is necessary for ensuring legitimacy and improving service discipline. The efficiency of disciplinary punishments imposed on law enforcement officers is determined by the quality of disciplinary proceedings and improving its legal regulation. The ways of improving juridical regulation of disciplinary proceedings in the Russian law enforcement agencies at the present stage of the reform are defined. The author argues the suitability of fixing in the Federal law “On the service in the RF law enforcement agencies and amendments to the particular RF legal acts” the right of law enforcement officers to obtain information about the facts of the case from the state authorities, organizations and establishments. Other proposals on improving the effective disciplinary proceedings’ legislation in law enforcement agencies are made. It is proposed to make some changes in terms of bringing to disciplinary liability, to set additional cases when law enforcement officers cannot participate in the internal inquiry and to determine the individuals who can declare the existence of such circumstances.
