Abstract

The principles of criminal law are defined not only as the principles of criminal legislation, but also as fundamental ideas, guiding principles, unconditional rules that are reflected in the norms of
the general and Special Parts of the criminal code of the Russian Federation, but are not named as such principles in the criminal law. The author of the article draws attention to the fact that fundamental ideas
are called principles only in case when they are fixed in the rules of law. The peculiarities of the content of the principles of criminal law when recognizing the person as insane are revealed, namely, the principles of
legality, equality, guilt, justice, humanism. When considering the peculiarities of the implementation of the principles of criminal legislation concerning the insane persons, it is noted that the legislative formulations of these principles do not take into account the criminal legal relations arising in the case when the insane person commits a socially dangerous act. Special principles of criminal law concerning insanity are distinguished, such as abstracting from the signs and symptoms of insanity, rational and economical use of
compulsory medical measures and individualization of criminal law measures applied to the insane persons. The shortcomings and gaps of the legislative regulation of the issues related to the recognition of a person as insane are considered. The proposals on improvement of criminal legislation are formulated.
