Abstract

Law enforcement activity in Russia is greatly complicated by the increasing number of migrants arriving from the countries of the near and far abroad, on the one hand, and the
multinational composition of the Russian state, on the other. Thus, there are many people in the country who have significant differences of external and internal character from the indigenous Russian macro
ethnic group. Some of these persons are periodically involved in the sphere of criminal proceedings.Ethnic differences should be taken into account while conducting the investigative and other procedural
actions during the investigation of crimes. The author proves the necessity of using the concept “advenal person (advenal)” as a scientific term, instead of the established terms “foreigner”, “migrant”; as well
as using the introduced criminalistic category of “advenal crimes” instead of “crimes committed by foreigners”, “crimes committed by members of ethnic organized criminal groups”. The article defines
the characteristics of an advenal person that have criminalistic significance. It is proposed to classify the advenals according to the anthropological type, the type of legal relationship with the Russian
Federation, the type of cultural affiliation and criminal procedure status. The author substantiates the significance of the criminalistic classification of advenal persons for the investigation and solution of
crimes connected with the activities of advenal persons.
