Abstract
|
The article discusses the peculiarities of the motivation of the court decision. The structure of motivating and its necessary elements are determined: objects, subjects of motivating and their activities, as well as the criteria for the motivation of the decision made. It is concluded that the objects of motivation are the elements to which the motivational activity of the court is directed: the factual circumstances, evidence (as well as other materials of the criminal case), a legal assessment of the circumstances that is inseparable from the previous objects, arguments of the parties. The level of proper motivation of the court decision is determined by the level of the necessary proof of the issue to be resolved and it also determines distinguishing of the various types of motivating: motivating of the maximum level (for final judicial decisions that resolve the criminal case on the merits); motivating of the high level (used for the decisions affecting the most important rights and freedoms of participants in criminal proceedings – on the application of the most strict measures of criminal procedure coercion; on the release on parole, etc.); motivating of the middle level (for the decisions that are less affecting the most important rights and freedoms of participants in criminal proceedings – on carrying out the investigative actions, etc.); motivating of the minimum level (for the decisions of a technical nature).
