Abstract

Currently there is a steady tendency towards an increase in the number of gang  crimes, which determines the relevance of the problems concerning the correct definition of the legal nature of complicity in a crime in the domestic criminal law. The solution of these problems is not only
of theoretical, but also of great practical importance, especially for the justification of criminal liability of accomplices of a criminal act. The understanding of the legal nature of complicity in a crime and
its essence has a direct impact on lawmaking activity. There is a difficulty concerning the definition of the legal nature of complicity in a crime. It is due to the fact that in some cases, complicity forms the
institution of the general part of the criminal law, while in other cases it is a separate crime provided by the special part of the criminal law. That is why it is important to justify the criminal liability of
accomplices in various forms and types of complicity in a crime at the theoretical level. The correct qualification of the behavior of all accomplices of a crime depends primarily on a clear understanding
and defining the essence of the legal nature of complicity. It is concluded that the institution of complicity in a crime combines both the accessory and independent principles of responsibility of accomplices of a crime.
