Abstract

The article deals with the issues related to the search of an individual and his (or her) belongings. In law enforcement practice, there are two types of inspection of an individual – external and personal. It is noted that the regulation of the procedure for carrying out an external
examination is contrary to the requirements of part 3 of article 55 of the Constitution of the Russian Federation, and the procedure for carrying out a personal search needs to be improved. The authors
of the article propose to amend part 4 of article 27.7 of the Code of Administrative Offences of the Russian Federation by the following points: 1) personal search is carried out if there are sufficient
grounds to believe that a physical person has not only weapons and items used as weapons, but also narcotic drugs, psychotropic substances or their analogues or new potentially dangerous psychoactive substances; 2) personal search may start at the scene of committing the administrative offence, and be completed in a separate room of the police station after bringing the individual there; 3) it
is possible to examine only the individual’s outerwear at the scene of committing the administrative offence; 4)рersonal search at the scene of committing the administrative offence is carried out by the
official, including the official of a gender different than the person being searched.
