Abstract
|
The article examines the concepts related to legal irresponsibility: “legal anomie”, “legal nihilism” and “offence”. The author defines their common and distinctive characteristics in order to identify the place of legal irresponsibility in the system of the related legal concepts. Various manifestations of legal irresponsibility are considered. The conclusions about its features in comparison with the characteristics of legal liability as a holistic legal phenomenon, including the positive and negative aspects of implementation, are made. According to the author’s opinion, legal irresponsibility at the institutional level is the lack or declarative character of the norms of legal responsibility or other imperfection of the legislation, that excludes the possibility of bringing to legal responsibility and its implementation. Legal irresponsibility at the level of implementation of the rules of law is the state of public relations, characterized by the commission of offences, avoiding the liability by the offender, the appointment of legal punishment that does not correspond to the nature and degree of social danger of the offence and the personality of the offender. Legal irresponsibility is connected with such phenomena as an offence, legal nihilism, legal idealism, legal anomie, but is not identical to them. The lack of effective law enforcement can lead to actual legal irresponsibility of the offender. In this regard, it is necessary to distinguish between formal legal liability and actual legal irresponsibility.
