Abstract

The institution of compulsory educational measures, which has great potential for the correction of minors who have committed a crime, is analyzed in the article. The authors of the article consider the peculiarities of the legislative regulation of coercive measures of educational influence at the current stage of the development of criminal law. Basing on the theoretical analysis and legal assessment supported by empirical material (statistical data, law enforcement practice and the surveys conducted among scientists, private practice lawyers, judges, law enforcement officers), the problems of regulation, legislative gaps and prospects for the development of the institution of compulsory educational measures are identified. Besides, the difficulties concerning the understanding of their content by the law enforcer are revealed. The absence of a detailed fixing of the grounds andprohibitions for imposing the considered measures in the legislation, as well as the inefficiency of using some of them and the limited list of their types are stated. Special attention is paid to those issues of the regulation of compulsory educational measures that are currently not regulated by the legislation, but are fundamentally important. The ways to improve the institution under consideration are proposed, the author’s vision of its legislative consolidation is offered, the corresponding amendments to the Criminal Code of the Russian Federation are formulated and substantiated.
