Abstract |
The current state and prospects for development of administrative legislation concerning control and supervision activities in the road sector, including the issues of administrative responsibility are analyzed. The state and development of this sphere depend on the design, construction, reconstruction, repair and maintenance of highways, as well as compliance with legal and technical rules governing the operation of road sector. But actually these entities have only the powers. The current RF Code of Administrative Offences traditionally establishes liability for administrative offences on transport and in the field of road traffic. The road sector as the object of administrative offences is not allocated in the draft of the new RF Code of Administrative Responsibility included in the project of the model program of legislative activities of the RF State Duma during spring session 2016. The authors prove the need for the introduction and detailed regulation of administrative responsibility not only in the field of road traffic or transport, but also for unskilled actions or omissions of the road sector authorities and their officials, leading to reduced efficiency of road sector operation and, as a consequence, to deteriorating economy. One of the reasons for the slow pace of road construction and poor road conditions is the lack of sanctions against road sector authorities and their officials responsible for the development and maintenance of the existing road network in good condition in the administrative law. Proposals for improving the legislation and practice of its application are made. |
