Abstract

The article deals with the problems of such institution of criminal law as other measures of criminal law nature. The relevance of the topic is due to the absence of the definition of other measures of criminal law nature in the relevant section of the Criminal Code of the Russian Federation, characteristics that distinguish them from other measures of state coercion, as well as the fact that the content of this section raises a number of questions and ambiguous interpretation. The opinions of the scientists in the field of criminal law concerning the considered institution are given. The author analyses both the existing types of other measures of criminal law nature enshrined in the criminal legislation, and other measures that can and should relate to the measures which generally differ from the punishment and criminal liability by their legal nature. A retrospective analysis of certain measures of state coercion is carried out in order to understand their criminal law nature. The author’s approach to the definition of the concept of other measures of criminal law nature, their distinguishing features and content is formulated. A different version of the section under consideration is proposed, namely, the exclusion of the rules concerning the confiscation of property and judicial penalty from it, and the addition of the provisions on coercive measures of educational nature.
